It did appear in the paper in the Guide section. It's a news photo to go with a restaurant review written by a news reporter. The reporter can say whatever s/he wishes about the restaurant, so it's certainly not an ad.
Additionally, reporters eat at a different time without notice and pay full price for whatever dishes they review.
If someone wishes, they might want to call it an illustration, but this image is "news."
